BeckOK Unified Patent Court, Eds. Nack/Zigann/Picht

The new Beck Online Commentary on the Unified Patent Court provides a comprehensive, practice-oriented, and continuously updated commentary on the new European Unitary Patent system, article by article. The Unified Patent Court (UPC) is an internationally organised court with two instances that handles disputes related to the European patent and plays a central role for businesses throughout Europe.

The commentary covers the key legal frameworks underpinning the Unitary Patent and the Unified Patent Court, including the:

  • Agreement on a Unified Patent Court (UPCA),
  • Rules of Procedure of the UPC (RoP),
  • Statute of the Unified Patent Court (UPCS),
  • Unitary Patent Regulation (EU) No 1257/2012,
  • Unitary Patent Translation Regulation (EU) No 1260/2012, and
  • other relevant provisions (e.g. interpretative notes of the Administrative Committee).

 

Special attention is given to the close interconnection between substantive patent law and procedural law. The commentary addresses practical issues and offers well-founded explanations that are indispensable for legal practitioners and the judiciary.

The editors – all renowned experts in patent law – are supported by 60 experienced contributors, including numerous judges of the UPC itself, both from the first instance (e.g. the central division in Paris, regional and local divisions in Germany, Scandinavia, and other UPC member states) and from the Court of Appeal in Luxembourg. This guarantees the highest level of expertise and practical relevance. The commentators’ profound knowledge of their various ‘home jurisdictions’ also creates a unique nexus between the unitary patent law and the national patent law traditions.

A key feature of this commentary is its consistent use of the English language. Since much of the patent advisory work under the new Unitary Patent system is conducted in English, the commentary is ideally tailored to the needs of European practice.

The online format of the commentary ensures quarterly updates. This allows for timely incorporation of new case law, academic discussions, and recent developments – both in national jurisprudence and before the European Patent Office (EPO). The high degree of dynamism and continuous change expected in the early years of the UPC will be optimally reflected in this commentary.

Furthermore, the work serves as the central reference for the English-language module PATENT LAW INTERNATIONAL on beck-online. It will become the leading English-language commentary on the UPC and create a vital resource for European users.
